These terms and conditions outline the rules and regulations for the use of Ask Energy Masters.

By accepting these terms, you consent to resolving all disputes through binding individual arbitration, which means you waive the right to have these disputes decided by a judge or jury, and you waive your right to participate in class actions, class arbitrations, or representative actions. The following terminology applies to these Terms and Conditions, Privacy Statement, and Disclaimer Notice, as well as all Agreements: "Client," "You," and "Your" refer to you, the person who logs onto this website and complies with the Company's terms and conditions. Refund Policy:

No goods are eligible for return unless they meet the following criteria:

The Goods were purchased in the last 30 days.
The Goods are in their original packaging.

The following Goods cannot be returned:

The supply of Goods made to Your specifications or clearly personalized.
The supply of Goods that, according to their nature, are not suitable for return, deteriorate rapidly, or have an expired date.
The supply of Goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
The supply of Goods that, according to their nature, are inseparably mixed with other items after delivery.

We reserve the right to refuse returns of any merchandise that does not meet the above return conditions in our sole discretion.

Only regular-priced Goods are eligible for a refund. Goods on sale, unfortunately, cannot be refunded. This exclusion may not apply to You if it is not permitted by applicable law.

Liability for Returned Goods:

You are responsible for the cost and risk of returning the Goods to Us. We cannot be held responsible for Goods damaged or lost in the return shipment. Therefore, We recommend using an insured and trackable mail service. We are unable to issue a refund without the actual receipt of the Goods or proof of received return delivery.

Site Administration

We maintain the right, though we are not obligated, to undertake the following actions:

Monitor the Site to identify violations of these Terms of Use.
Initiate appropriate legal actions, at our sole discretion, against any user who, in our judgment, violates the law or breaches these Terms of Use. This may include reporting such users to law enforcement authorities.
We may, at our sole discretion and without any limitations, decline, restrict access to, decrease availability, or, to the extent technologically feasible, disable any of your Contributions or specific parts thereof.
At our sole discretion and without limitations, we may also remove from the Site or disable any files and content that are excessively large or place an undue burden on our systems.

Mandatory and Binding Arbitration

By accepting these terms, you and we agree to mandatory and binding arbitration to resolve any and all disputes related to or arising from your use of this site and any products or services ordered on this site. You and we understand and acknowledge that by agreeing to mandatory and binding arbitration, you and we have waived the right to a trial by jury or a trial by a judge.

Class Action Waiver

This includes, without limitation, as a representative member of a class or in a private attorney general capacity, in connection with any dispute.

Indemnification

You consent to indemnify, defend, and hold harmless Ask Energy Masters, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement, your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. Ask Energy Masters reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will fully cooperate with Ask Energy Masters in asserting any available defenses.

Arbitration

If the parties are unable to resolve any dispute arising from or related to these Terms and Conditions, including contract, tort, or other legal or equitable claims for damages or other relief, such dispute will be exclusively settled through final and binding arbitration. The arbitration will be conducted by a single neutral arbitrator and administered by the American Arbitration Association or a similar arbitration service chosen by the parties, at a location agreed upon by both parties. The arbitrator's decision will be binding and can be enforced in any court with jurisdiction.

In the event that a legal or equitable action, proceeding, or arbitration arises from or pertains to these Terms and Conditions, the prevailing party will have the right to recover its costs and reasonable attorney's fees. The parties commit to arbitration for all disputes and claims related to these Terms and Conditions, whether direct or indirect, including Tort claims resulting from these Terms and Conditions. This provision is governed by the Federal Arbitration Act, including the interpretation and enforcement thereof. The Arbitrator will determine the entire dispute, including the scope and validity of this arbitration provision. This arbitration provision will remain in effect even after the termination of these Terms and Conditions.

Termination and Access Restriction

Ask Energy Masters retains the right, at its sole discretion, to cease your access to the Site and its associated services, or any portion thereof, without the need for prior notice. This agreement is subject to the laws of the State of New Jersey, and you consent to the exclusive jurisdiction and venue of courts in New Jersey for all disputes arising from or related to the use of the Site. Usage of the Site is not authorized in jurisdictions that do not recognize or enforce all provisions of these Terms, including this section.

You acknowledge that no partnership, joint venture, employment, or agency relationship is established between you and Ask Energy Masters due to this agreement or your use of the Site. Ask Energy Masters' performance of this agreement is subject to compliance with existing laws and legal processes. This agreement does not diminish Ask Energy Masters' right to comply with governmental, court, and law enforcement requests or requirements pertaining to your use of the Site or information gathered by Ask Energy Masters in connection with such use.

If any part of this agreement is determined to be invalid or unenforceable in accordance with applicable law, including disclaimers of warranties and limitations of liability, the invalid or unenforceable provision shall be replaced with a valid and enforceable provision that best reflects the intention of the original provision. The rest of the agreement shall remain in effect.

Unless otherwise specified, this agreement constitutes the full agreement between you and Ask Energy Masters concerning the Site, replacing all prior or contemporaneous communications, whether electronic, oral, or written. Printed copies of this agreement and electronically delivered notices will be admissible in judicial or administrative proceedings associated with this agreement to the same extent and under the same conditions as other business documents and records originally produced and maintained in printed form. The intention of both parties is for this agreement and related documents to be composed in English.

YOU AGREE AND UNDERSTAND THAT ANY VIOLATION OF THESE SERVICE TERMS BEFORE THE COMPLETION OF THE SERVICE(S) MAY LEAD TO THE CANCELLATION OF YOUR SERVICE APPOINTMENT OR THE REFUSAL TO INITIATE OR, IN CASES WHERE THE SERVICE(S) ARE NOT YET FINISHED, TO CONTINUE THE SERVICE(S).

Changes to the Terms

Ask Energy Masters holds the right, at its sole discretion, to amend the Terms under which www.askenergymasters.com is provided. The most recent version of the Terms will override all previous versions. We encourage you to periodically review the Terms to stay informed about updates.
